Terms of Use

These terms are an agreement between you and Katechon Technology, Inc. for the Cast Cards app and the Cast website. By using Cast you agree to them, so please read them. If you don’t agree, don’t use Cast.

1. Who we are and what Cast is

Cast is made by Katechon Technology, Inc., a Delaware corporation based in Butte, Montana (“Katechon”, “we”, “us”). Cast is a card game for short drama episodes: you open packs of story cards, and each card you play chooses what happens next. Our Privacy Policy explains how we handle your data and is part of these terms.

If you got the app from the App Store, Apple’s Licensed Application End User License Agreement governs your license to the app itself, and these terms cover everything else. Apple is not a party to these terms and isn’t responsible for Cast or its content.

2. Who can use Cast

You must be at least 13 years old, and old enough to consent to data processing where you live. If you’re under 18 (or the age of majority where you live), you need a parent’s or guardian’s permission, and they accept these terms for you, including responsibility for purchases. You may not use Cast if the law forbids it, including if you are in a country under a US embargo or on a US list of prohibited or restricted parties.

7. Acceptable use

You agree not to:

We have zero tolerance for objectionable content and abusive players. We may remove any scene or content, and suspend or close any account, that we believe breaks these terms.

8. Reporting and hiding scenes

In the app, open a scene’s ••• menu and choose Report this scene, or Hide scenes by @handle to stop seeing that creator’s scenes. On the website, or for anything else, email simon@katechon.technology with a link to the scene. We review reports within 24 hours and remove scenes that break these terms. A scene reported by several players is hidden automatically while we review it.

If you believe something in Cast infringes your copyright or trademark, email simon@katechon.technology with the material, your rights in it and your contact details.

10. Disclaimers

Cast is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise that Cast will be uninterrupted, error-free, or that scenes will film successfully or quickly.

11. Limitation of liability

To the fullest extent the law allows, Katechon won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about Cast is limited to the greater of the amount you paid for Cast in the 12 months before the claim and US $50. Some places don’t allow these limits, so they may not apply to you; nothing in these terms limits liability that the law doesn’t allow us to limit.

12. Indemnity

If you break these terms or the law while using Cast, you agree to cover Katechon’s reasonable losses and costs from claims by others that result, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-law rules. Disputes will be heard by the state or federal courts located in Montana, and you and Katechon consent to their jurisdiction. If you live in the European Union, the United Kingdom or another place whose consumer laws give you rights that can’t be waived, those rights still apply, and you may also bring a claim in your local courts. Before filing a claim, please email simon@katechon.technology so we can try to resolve it.

14. Changes and general terms

We may update these terms. We’ll post changes here and update the date below, and tell you in the app or on the website before a material change takes effect. If you keep using Cast after that, you accept the new terms. If any part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver. You may not transfer these terms; we may transfer them as part of a sale or reorganization of our business.
